Die Beitrage dieses Bandes, die auf eine Tagung anlasslich der Prasentation des Edith Stein-Lexikons an der FernUniversitat in Hagen im November 2017 zuruckgehen, machen das systematische und ideengeschichtliche Profil in Steins Denken transparent. In their recent Opinion in TiCS, Yildirim and Paul propose that large language models (LLMs) have ‘instrumental knowledge’ and possibly the kind of ‘worldly’ knowledge that humans do. They suggest that the production of appropriate outputs by LLMs is evidence that LLMs infer ‘task structure’ that may reflect ‘causal abstractions of... entities and processes in the real world.' While we agree that LLMs are impressive and potentially interesting for cognitive science, we resist this project on two grounds. First, it casts (...) LLMs as agents rather than as models. Le monde, tel que nous le partageons et lui donnons sens, ne se découpe pas seulement en individus, en classes ou en groupes, mais aussi en "styles", qui sont (...) autant de phrasés du vivre, animé de formes attirantes ou repoussantes, habitables ou inhabitables, c'est-à-dire de formes qualifiées : des formes qui comptent, investies de valeurs et de raisons d'y tenir, de s'y tenir, et aussi bien de les combattre. C'est sur ce plan des formes de la vie que se formulent aujourd'hui beaucoup de nos attentes, de nos revendications, et surtout de nos jugements. Most decision-making research in economics focuses on individual decisions. Yet, we know, from psychological research in particular, that individual preferences can be sensitive to social pressures. In this paper, we study the impact of a group environment on individual preferences for risky and ambiguous prospects. In our experiment, each participant was invited to make a series of lottery-choice decisions in two different conditions. In the Alone condition, individuals made private choices, whereas in the Group condition, individuals belonged to a three-person (...) group and group members’ choices were aggregated according to either a majority or unanimity rule. This design allows us to study the impact of a group environment on individuals’ attitude towards both risky and ambiguous prospects, while controlling for the decision rule used in the group. Our experimental results show that when individuals are in the Group condition, they tend to be less risk averse and more ambiguity averse than when they are not part of a group. Our experiment also suggests that the decision rule matters as it shows that these two trends tend to be stronger when the group implements a unanimity rule. Specifically, we found that individuals who belong to a group implementing a unanimity rule are significantly less risk averse than individuals who belong to a group that relies on the majority rule. We obtained a similar—but non-significant—result under ambiguity. (shrink)

Should nurses have their own ethics to match specific problems met in their daily routines? How do nurses act in a society that is changing from a 'monocultural' to an 'intercultural' structure? What are the ethical consequences of these changes for their many tasks? How can the ethical aspects be taught to nurses? This article describes the current status of nursing ethics in the curriculum taught in schools of higher education for nurses in The Netherlands. Aspects of the debate on (...) nursing ethics are outlined and ideas about its future as a subject and discipline in nurse education are offered. Est-ce que le personnel infirmier doit avoir son éthique à soi pour faire face aux problèmes spécifiques dans la routine journalière? Et comment les infirmiers/ères se comportent-ils dans une société qui est en train de changer de la 'monoculture' en 'interculture'? Quels sont les conséquences éthiques de leur tâches? Comment peuvent ces aspets éthiques être enseignés aux infirmiers/ères? Cet article parle de l'état courant de l'éthique infirmier dans l'enseignement dans les écoles de l'education supérieure pour infirmiers/ères en Hollande. En plus, il donne une esquisse de la discussion sur l'éthique infirmier et donne quelques idées pour le futur de l'éthique infirmier comme sujet et discipline en soi dans l'éducation des infirmiers/ères. Sollte das Pflegepersonal seine eigene Ethik haben um den spezifischen Problemen seiner täglichen Routine gewachsen zu sein? Wie soll das Pflegepersonal in einer Gesellschaft handeln, die im Wechsel ist von einer 'Monokultur' zu einer 'Interkultur'? Was sind die ethischen Konsequenzen ihres handeln? The assumption in current U.S. mainstream medicine is that birthing requires hospitalization. In fact, while the American College of Obstetricians and Gynecologists supports the right of every birthing person to make a medically informed decision about their delivery, they do not recommend home birth owing to data indicating greater neonatal morbidity and mortality. In this article, we examine the evidence surrounding home birth in the United States and its current limitations, as well as the ethical considerations around birth setting.

This paper seeks to find possibilities forreconciliation of the implementation of theprecautionary principle and the promotion ofinternational trade of genetically modified organisms,based on the assumption that a sustainabledevelopment is a right objective to strive for. Itstarts with an explanation of the background and therole of the precautionary principle, and describes inwhat way measures based on the precautionary principlecan easily lead to the creation of trade barriers. Thearticle then examines to what extent the WTO (WorldTrade Organisation) Agreements allow theimplementation of the (...) precautionary principle. Inaddition, structural conflicts between the perceptionof the precautionary principle and the concept oftrade liberalisation will be evoked. Antes dela reforma de 1994, el derecho a la vida no estaba contemplado en el texto constitucional.Esto implica que cualquier persona que perciba que sus derechos fueronvulnerados puede disponer de un inmediato recurso de amparo para que cese tal acciónsobre él. Desde 1994 en adelante, los tratados adquieren carácter supralegal, enel sentido de que ocupan un lugar debajo de la Constitución, pero por encima de lasleyes y resto del (...) derecho interno. Es así, como consecuencia, que Argentina adhiereal Pacto de San José de Costa Rica, que en su artículo 25 establece el derecho de losindividuos a recursos que lo amparen contra cualquier tipo de acto que viole o lesionesus derechos fundamentales reconocidos por la Constitución, la ley o esa mismaconvención. El presente trabajo propone analizar la manera en que Agustín de Hipona recepciona el pensamiento de Tertuliano, autor cristiano latino, también africano, del que lo separan unos 200 años. Las principales menciones al cartaginés tienen lugar en la crítica agustiniana a la concepción de la corporeidad del alma defendida por Tertuliano. A fin de poder analizar los argumentos y los conceptos filosóficos utilizados por el hiponense en el desarrollo de su crítica presentamos, en primer lugar, una breve introducción a Tertuliano (...) (c. 160- c. 220), deteniéndonos en algunos pasajes cruciales de su obra titulada _De anima_ (208/210). En segundo lugar, nos dedicamos a presentar y analizar la discusión que lleva adelante Agustín respecto de la tesis de la corporeidad del alma humana en _De Genesi ad litteram _(finalizado hacia el 415)_,_ y en _De anima et eius origine, _escrita posteriormente, entre 419 y 420. Evaluamos entonces la posición del hiponense respecto de la hipótesis traducionista sobre el alma humana, ciertamente vinculada al corporalismo defendido por Tertuliano. (shrink)

The fragility of the subject is a recurring issue in the work of Anne Enright, one of Ireland's most remarkable and innovative writers. It is this specific interest, together with her attempt to make women into subjects, that inevitably links her work to Bracha Lichtenberg-Ettinger's theory of the matrixial borderspace, a feminine sphere that coexists with the Lacanian symbolic order and that, even before our entrance into this linguistic system, informs our subjectivity. By turning to a point in time before (...) language—the encounter between “self” and “other” during pregnancy—both Enright and Ettinger test the boundaries of and the gaps within the linguistic system. It is the going before language that ultimately enables both to go beyond some of the most persistent dualisms present within the linguistic system and to create room for an alternative—a feminine—understanding of the ethical relationality between self and other. Pitch labeling in absolute pitch (AP), the ability to recognize the pitch class of a sound without an external reference, is effortless, fast, and presumably automatic. Previous studies have shown that pitch labeling in AP can interfere with task demands. In the current study, we used a cued auditory Go/Nogo task requiring same/different decisions to investigate both behavioral and electrophysiological correlates of increased inhibitory demands related to automatic pitch labeling. The task comprised two Nogo conditions: a Nogo condition with pitch (...) differences larger than one semitone, and a second Nogo condition with pitch differences of only a quarter semitone. The first Nogo condition tested if auditory-related inhibition processes are generally altered in AP musicians. The second Nogo condition tested the suppressibility of the pitch labeling using a Stroop-like effect: the two tones belonged to the same pitch class but were not identical in terms of tone frequency. If pitch labeling cannot be suppressed, the conflicting information would be expected to increase the inhibitory load in AP musicians. Our data provided no evidence for an increased difficulty to inhibit a prepotent response or to suppress conflicting pitch-labeling information in AP: AP musicians showed similar commission error rates as non-AP musicians in both Nogo conditions. N2d and P3d amplitudes of AP musicians were also comparable to those of non-AP musicians. The event-related potentials (ERPs) were, however, modulated by the Nogo condition, probably indicating an effect of stimulus similarity. It is possible that, depending on the context, pitch labeling in AP musicians is not entirely automatic and can be suppressed. (shrink)

One unique challenge in teaching Christian health care ethics involves helping students to appreciate the delicate context of clinical decision-making scenarios. Another challenge involves helping students to empathize with the perspectives and appreciate the expertise of various parties. Finally, students need clear examples of the dangers of reductive medical paradigms. Toward these goals, mock clinical ethics consultations can help students to value respectful ethical discourse and to build necessary virtues for effectively engaging in such dialogue, such as humility, gentleness, and (...) prudence. The goal of mock clinical ethics consultations is to achieve deeper understanding of the moral dimensions of an assigned scenario and the human relationships at stake. This practice can serve as a model for other classroom activities in broad fields of Christian ethics that invite students to cultivate virtues for charitable dialogue, to apply ethical analysis to concrete scenarios, and to consider the relationship of class content to personal vocation. En este trabajo abordamos la concepción del hombre de Tertuliano, pensador africano del siglo II, en el marco de su inserción en la tradición apologista de Justino e Ireneo. Al igual que ellos, el cartaginés adopta una consideración positiva del cuerpo, más específi camente de la carne, como elemento constitutivo en la definición del hombre, pareciendo asumir, en ocasiones, la carga de la especificidad humana. Sin embargo, Tertuliano atiende a la noción de alma como un aspecto central de su esquema (...) antropológico en un escrito que le dedica especialmente. En este sentido, desarrollamos en el artículo los conceptos de corpus, caro y anima a la luz de la tensión respecto de lo que a veces indica una primacía de un aspecto por sobre el otro. A partir del análisis principalmente de la obra De anima y de algunas menciones al Libro II de Adversus Marcionem, concluimos que prevalece en Tertuliano una perspectiva unitaria sobre el hombre. The McGurk illusion occurs when listeners hear an illusory percept, resulting from mismatched pairings of audiovisual speech stimuli. Hearing a third percept—distinct from both the auditory and visual input—has been used as evidence of AV fusion. We examined whether the McGurk illusion is instead driven by visual dominance, whereby the third percept, e.g., “da,” represents a default percept for visemes with an ambiguous place of articulation, like/ga/. Participants watched videos of a talker uttering various consonant vowels with and without audios (...) of/ba/. Individuals transcribed the CV they saw or heard. In the V-only condition, individuals predominantly saw “da”/“ta” when viewing CVs with indiscernible POAs. Likewise, in the AV condition, upon perceiving an illusion, they predominantly heard “da”/“ta” for CVs with indiscernible POAs. The illusion was stronger in individuals who exhibited weak/ba/auditory encoding. In Experiment2, we attempted to replicate these findings using stimuli recorded from a different talker. The V-only results were not replicated, but again individuals predominately heard “da”/“ta”/“tha” as an illusory percept for various AV combinations, and the illusion was stronger in individuals who exhibited weak/ba/auditory encoding. These results demonstrate that when visual CVs with indiscernible POAs are paired with a weakly encoded auditory/ba/, listeners default to hearing “da”/“ta”/“tha”—thus, tempering the AV fusion account, and favoring a default mechanism triggered when both AV stimuli are ambiguous. To help eliminate perinatal HIV transmission, the US Department of Health and Human Services recommends against breastfeeding for women living with HIV, regardless of viral load or combined antiretroviral therapy status. However, cART radically improves HIV prognosis and virtually eliminates perinatal transmission, and breastfeeding's health benefits are well-established. In this setting, pregnancy is increasing among American women with HIV, and a harm reduction approach to those who breastfeed despite extensive counseling is suggested. We assess the evidence and ethical justification for (...) current policy, with attention to pertinent racial and health disparities. We first review perinatal transmission and breastfeeding data relevant to US infants. We compare hypothetical risk of HIV transmission from breastmilk to increased mortality from sudden infant death syndrome, necrotizing enterocolitis and sepsis from avoiding breastfeeding, finding that benefits may outweigh risks if mothers maintain undetectable viral load on cART. We then review maternal health considerations. We conclude that avoidance of breastfeeding by women living with HIV may not maximize health outcomes and discuss our recommendation for revising national guidelines in light of autonomy, harm reduction and health inequities. Prenatal ultrasound use is skyrocketing despite limited evidence of improved outcomes. One factor driving this trend is the widely recognized psychological appeal of real-time fetal imaging. Meanwhile, considering imperfect safety evidence, U.S. professional guidelines dictate that prenatal ultrasound—a screening test—should be governed by expected clinical benefits—an opportunity for intervention. However, when women’s healthcare professionals themselves are pregnant, their access to ultrasound technology permits informal, personal use that may deviate from standard-of-care, e.g., for reassurance. Highlighting a poignant case wherein a pregnant (...) obstetrician’s personal ultrasound use had unforeseen negative consequences, we explore this issue within context of professional ethics and informal medical care. We discuss how women’s health professionals’ self-care may influence and inform prenatal care at large. We advocate curtailing informal prenatal ultrasound use, but also potentially broadening accepted indications for or relaxing proscriptions against ultrasounds for patients. Further research and updated, evidence-based, ethically-sound guidelines are needed. (shrink)

Common hospital and surgical center responses to the Covid‐19 pandemic included curtailing “elective” procedures, which are typically determined based on implications for physical health and survival. However, in the focus solely on physical health and survival, procedures whose main benefits advance components of well‐being beyond health, including self‐determination, personal security, economic stability, equal respect, and creation of meaningful social relationships, have been disproportionately deprioritized. We describe how female reproduction‐related procedures, including abortion, surgical sterilization, reversible contraception devices and in vitro fertilization, (...) have been broadly categorized as “elective,” a designation that fails to capture the value of these procedures or their impact on women's overall well‐being. We argue that corresponding restrictions and delays of these procedures are problematically reflective of underlying structural views that marginalize women's rights and interests and therefore threaten to propagate gender injustice during the pandemic and beyond. Finally, we propose a framework for triaging reproduction‐related procedures during Covid‐19 that is more individualized, accounts for their significance for comprehensive well‐being, and can be used to inform resumption of operations as well as subsequent restriction phases. In the USA, there are missed opportunities to diagnose hepatitis C virus (HCV) in pregnancy because screening is currently risk-stratified and thus primarily limited to individuals who disclose history of injection drug use or sexually transmitted infection risks. Over the past decade, the opioid epidemic has dramatically increased incidence of HCV and a feasible, well-tolerated cure was introduced. Considering these developments, recent evidence suggests universal HCV screening in pregnancy would be cost-effective and several professional organisations have called for updated national (...) policy. Historically, universal screening has been financially disincentivised on the healthcare system level, particularly since new diagnoses may generate an obligation to provide expensive treatments to a population largely reliant on public health resources. Here, we provide ethical arguments supporting universal HCV screening in pregnancy grounded in obligations to respect for persons, beneficence and justice. First, universal prenatal HCV screening respects pregnant women as persons by promoting their long-term health outside of pregnancy. Additionally, universal screening would optimise health outcomes within current treatment guidelines and may support research on treatment during pregnancy. Finally, universal screening would avoid potential harms of risk-stratifying pregnant women by highly stigmatised substance use and sexual behaviours. (shrink)

Pregnant people experience moral judgment in healthcare settings that may be coded into clinical documentation. Stigmatizing language in medical records transmits bias between clinicians, potentially exacerbating disparities in maternal morbidity and mortality. We examined obstetrical records from 100 randomly selected patients who received prenatal and delivery care in an academic hospital system. Qualitative analysis sought to identify linguistic features conveying negative attitudes or moral judgment, revealing themes of epistemic injustice: (1) discrediting patient testimony as incompetent, unreliable, and hysterical; (2) unnecessary (...) details that are objectifying, stigmatizing, or unprofessional; and (3) judgments of maternal fitness, where women are labeled “bad mothers” by emphasizing neglectful, selfish, and debauched characteristics. We conclude by advocating for further validation of our findings, revisiting medical education paradigms, and supporting the development of natural language processing (NLP) technologies to detect and intercept stigma. Background: Little is known about U.S. healthcare provider views and practices regarding evidence, counseling, and shared decision-making about in-hospital versus out-of-hospital birth settings. Methods: We conducted 19 in-depth, semistructured, qualitative interviews of eight obstetricians, eight midwives, and three pediatricians from across the United States. Interviews explored healthcare providers’ interpretation of the current evidence and their personal and professional experiences with childbirth within the existing medical, ethical, and legal context in the United States. Results: Themes emerged concerning risks and benefits, decision-making, (...) and patient-provider power dynamics. Collectively, the narratives illuminated fundamental ideological tensions between in- and out-of-hospital providers arising from divergent assignment of value to described risks and benefits. The majority of physicians focused on U.S.-specific data demonstrating increased neonatal morbidity and mortality associated with delayed access to hospital-based interventions, thereby justifying hospital birth as the standard of care. By contrast, midwives emphasized data demonstrating fewer interventions and superior maternal and neonatal outcomes in high-income European countries, where out-of-hospital birth is more common for low-risk birthing people. A key gap in counseling was revealed, as no interviewees offered anticipatory counseling regarding birth setting options. Providers directly and indirectly illustrated the propensity for asymmetric power relations between birth providers and pregnant people, especially in hospital settings. Conclusions: The narratives highlight the common goal of optimizing maternal and neonatal outcomes despite tensions arising from divergent prioritization of specific maternal and neonatal risks. Our findings suggest opportunities to foster collaboration and optimize outcomes via mutual respect and improved integration of care. (shrink)

Søren Kierkegaard verweigert dezidiert die Standards akademischen Schreibens und betont die Unumgänglichkeit von "indirekter Mitteilung", wenn es um Glaubenswahrheit geht: Das Bemühen um stringente Argumentation und definitorisch gesicherte Termini führe zu Abstraktheit und Fixierung. Damit sei es indifferent gegenüber der einzigartigen und veränderlichen existentiellen Konstellation des Individuums. Kierkegaard geht es vielmehr darum, wie man die eigenständige, persönliche Sinnfindung des Gesprächspartners anregen kann, ohne dies durch die eigene Rede zu beeinflussen. Das Buch untersucht, welche sprachlichen und textuellen Maßnahmen diesem Programm geschuldet (...) sind. Mit Rekurs auf das Denken des theologisch weitgehend abstinenten Ludwig Wittgenstein wird deutlich, daß dieses Problem nicht nur religiöse Rede affiziert und daß das Ideal direkter Mitteilung fragwürdig ist. Es ergeben sich Konvergenzen zwischen den beiden Autoren, die bis in semiotische und epistemologische Implikationen reichen und den Unterschied zwischen Glauben und Wissen neu diskutieren lassen. Conscience – a catholic anthropological vision In the catholic tradition conscience always played an important role as visible in the ‘clausula Petri’ (Ac 5,30-33) or in Paul’s belief in its wisdom (Rm 2,14-16). Conscience can break rules (‘epikeia’), but should not stand up against the church as such. Luther’s historical deed left behind a distrust in conscience in the Catholic Church; it took 400 years to restore Paul’s vision of the conscience as the highest authority – if it is formed (...) and reaches the state of maturity. By his conscience, man is called to be as God created him; he is called by others to develop and to respect their dignity. He is also called by the world to form it according to its higher possibilities which cannot be realized but by man. Conscience is God’s voice in the person where his promises can be heard. Though conscience is free, it is the place where responsibility is formed according to what someone can and should do. This is why the conscience will keep its unavoidable and undeniable role – even in a postmodern context. (shrink)

Pregnancy presents some interesting challenges for the philosophy of embodied cognition. Mother and fetus are generally considered to be passive during pregnancy, both individually and in their relation. In this paper, we use the enactive operational concepts of autonomy, agency, individuation, and participation to examine the relation between mother and fetus in utero. Based on biological, physiological, and phenomenological research, we explore the emergence of agentive capacities in embryo and fetus, as well as how maternal agency changes as pregnancy advances. (...) We show that qualitatively different kinds of agency have their beginnings already in utero, and to what extent fetal and maternal movement modulate affectivity and individuation in pregnancy. We thus propose that mother and fetus are both agents who participate in pregnancy. Pregnancy then emerges as a relational developmental organization that anchors and holds its developing participants. We end the paper with reflections on ethical implications of this proposal, and suggestions for future research. (shrink)

At Universitat Politècnica de València, Meridies, an internship programme that places engineering students in countries of Latin America, is one of the few opportunities the students have to explore the implications of being a professional in society in a different cultural and social context. This programme was analyzed using the capabilities approach as a frame of reference for examining the effects of the programme on eight student participants. The eight pro-public-good capabilities proposed by Melanie Walker were investigated through semi-structured interviews. (...) The internship is an environment in which students can put into practice the knowledge they have acquired in undergraduate studies and to find practical relevance in what they studied. Occasionally, this also entails a critical questioning of what they have learned, a greater awareness of the limits of the contents of their studies and of the way things were taught, and interest in less explored issues that are closely linked to social justice. However, tensions can arise between the pro-public-good oriented perspectives of this programme, and a more instrumental vision. One way to overcome these tensions is to foster consideration of reflexivity, that is, the dynamic relationship between technology and society. To do so, the programme must create space before and during the internship, and upon the return of the students, to discuss and collectively reflect upon their lived experience. Additionally, it ought to engage supervisors in this educational journey, both at the university and in the host institutions, and also involve socially committed organisations in this task. With growing vigor, political philosophers have started questioning the Westphalian system of states as the main actors in the international arena and, within it, the doctrine of Permanent Sovereignty over Natural Resources. In this article I add to these questionings by showing that, when it comes to migratory natural resources, i.e., migratory species, a plausible theory of territorial rights should advocate a regime of shared sovereignty among states. This means that one single entity should represent their interests and maybe also (...) those of third parties, managing and making decisions over the resource as a whole. Although such a regime might be the tacit goal of existing international conventions regarding wildlife, it remains untheorized in political philosophy and largely under-theorized in international law. By presenting the critical situation of the monarch butterfly in North America, I point to the inadequacy of the compartmentalized current regime, which generates injustice in migration; namely, the phenomenon whereby range states of a given species may neglect or over-exploit it while in their territory, to the detriment of others. I suggest that more flexible and imaginative governance arrangements are needed to deal in a better way with these and similar natural resources. (shrink)

Given the grim global statistics of extreme poverty and socioeconomic inequalities, moral and political philosophers have focused on the duties of justice and assistance that arise therefrom. What the needy are morally permitted to do for themselves in this context has been, however, a mostly overlooked question. Reviving a medieval and early modern account of the right of necessity, I propose that a chronically deprived agent has a right to take, use and/or occupy whatever material resources are required to guarantee (...) her self-preservation, or the means necessary to acquire them. There are three individually necessary and jointly sufficient conditions: the need is basic, the claimant does not violate other equally important moral interests, and it is a last resort. I present two recommendations to be followed by the claimants, and offer some examples where this principle may be applied today. I reply to the objections that understanding the right of necessity in this way kills its intuitive plausibility, and that it is a remedy worse than the disease. I conclude that, while not the best solution for the problem of global poverty, the exercise of this right should be accepted if we believe in the human right to subsistence. (shrink)
